1. General

1.1. The promotion is titled “New Year's Eve with FxCash”, and hereinafter is referred to as 'the Promotion'.

1.2. The Promotion is run by FXCASH OU (hereinafter, the 'Management'), the owner of fxcash.net website (hereinafter, the 'Service').

1.3. Under these Promotion Terms and Conditions, the following prizes shall be drawn:

• 1st place: Apple iPhone 13 128GB;
• 2nd place: 350$ to FXCASH balance;
• 3rd place: 300$ to FXCASH balance;
• 4nd place: 250$ to FXCASH balance;
• 5rd place: 200$ to FXCASH balance;
• 6nd place: 150$ to FXCASH balance;
• 7rd place: 100$ to FXCASH balance;
• 8th place: 50$ to FXCASH balance.

1.4. The Promotion is valid from December 7, 2021 to January 31, 2022 (hereinafter, the 'Promotion Time Frame').

2. Promotion Participants

2.1. Any person legal of age and sound of mind may take part in the promotion as long as they are the Service users and have valid real money accounts with any broker included into the Service Partner List (hereinafter, the 'Participant').

3. Terms

3.1. For each USD10 payment credited by the broker to the Participant's account, the Participant gets one (1) FX Point.

3.2. The number of FX Points earned is displayed in the Service website member area, under the “New Year's Eve with FxCash” section.

3.3. Under the Promotion Terms and Conditions, the payments credited to Participant's account shall be valid only in case the Promotion Holder receives a partnership commission from the brokers in regard to any such payments.

3.4. The Participant shall act in compliance with all accepted and effective agreements made with all brokers the Participant has an account with, as well as the Service Public Offer Agreement.

3.5. The Participant may refuse to take part in the Promotion by commenting so to Customer Support using the following email address: [email protected].

3.6. In case the brokerage firm opts to cancel its payment to the Participant trading account, or in case the Participant violates these Terms and Conditions, the Management reserves the right to exclude the Participant's account from the Promotion.

4. The Winner Determination

4.1. The Promotion Winners (hereinafter, the 'Winners') shall be determined as the Promotion Participants who scored the maximum number of FX Points within the Promotion Time Frame. The places are given in accordance with the amount of FX Points scored.

4.2. Final FX Points count and the Winners Determination shall be carried out until February 15, 2022.

4.3. The funds credited in February 2022 for January 2022 trading are also applied against the final FX Points count.

5. Receiving the Prizes

5.1. General Provisions

5.1.1. The Winner and the Promotion Holder shall approve the Prize receiving method within 45 days after the Promotion has expired.

5.1.2. After the Winners Determination, the Promotion Holder shall verify the Participants' details, as well as whether their participation was legit as per Cl. 2.1, and Cl. 3.1.-3.6, as well as applicable laws and regulations. In case any personal details of the Participant are not authentic, or in case the Participant has no right to participate in the Promotion, the Winning Place of such a Participant shall be void.

5.1.3. In case the Participant violates these Promotion Terms and Conditions, the Promotion Holder reserves the right to deny the Prize to the Participant.

5.2. The main Prize: Apple iPhone 13 128GB

5.2.1. Apple iPhone 13 128GB may be shipped to any destination throughout the world, as approved by the Winner.

5.2.2. Once the Prize has been received, each Participant of the Promotion shall be fully liable for any taxes and other charges, as determined by applicable laws and regulations of the Participant's jurisdiction.

5.2.3. The Promotion Holder shall cover all costs and expenses associated with shipping the Prize to the Participant's destination. The Winner shall be liable for any taxes, customs duties, and other related fees and expenses.

5.3. Cash prizes:
The cash Prizes are credited to the Winners’ FxCash account within 10 business days after the Winners Determination and are available for withdrawal.

6. Conclusion

6.1. The Management shall take all necessary steps to protect the information regarding the Promotion from unauthorized use. The Management shall not be bound with an obligation to share the information regarding the Promotion with a third party.

6.2. All disputes arisen regarding the Promotion and its results shall be settled through negotiations.

6.3. By taking part in the Promotion, the Participant hereby confirm that has fully read and agreed with the Promotion Terms and Conditions.

6.4. In case the Participant refuses to act in compliance with all Promotion Terms and Conditions, the Management reserves the right to cancel their participation.
